Sidney Powell, attorney representing Lt. General Michael Flynn, Ret., former National Security Adviser, submitted a 19-page court filing in DC Federal Court claiming the Government prosecution team had engaged in “egregious conduct and suppression” of possibly exculpatory evidence.
In a status conference in Federal Court in Washington, Powell argued that the case is not ready for sentencing because General Flynn has not received all the documents the government is holding on the case as the judge had ordered. She cited a Supreme Court case Brady v. Maryland which establishes the Government’s obligation to turn over all evidence to the defendant.
The Government is withholding documents needed for General Flynn’s defense while hiding behind secret classification of the documents. Powell claims that in particular, there is being withheld an internal DOJ memo that “exonerates” General Flynn.
